AI-Generated Content & Intellectual Property

We believe Backstroke customers deserve clarity on how AI-generated content intersects with copyright, and we design our workflows with that in mind.

When we generate images entirely through AI tools, customers should be aware that under current U.S. law, fully AI-generated images are generally not eligible for copyright protection, as the Copyright Office requires human authorship. This means those assets cannot be exclusively owned by any party. Where exclusive ownership matters, we recommend that your designers substantially modify AI-generated imagery to strengthen the copyright position, and we're always happy to discuss the right approach for your use case.

Our preferred and most common workflow, using customer-provided imagery with AI-assisted copy overlays, is on much stronger legal footing. In this model, the client retains full copyright over their original assets, and our team's creative decisions around copy, placement, and styling constitute the kind of human authorship that supports a clear ownership position.

In either scenario, we take care to ensure AI-generated copy doesn't inadvertently reproduce trademarked language belonging to others, a standard we hold regardless of whether copy is written by hand or with AI assistance.
